Please read these Terms of Use (“Terms”) carefully before accessing or interacting with our automated conversational AI assistant (including “ReWild QuickStart” or related interactive chat features, collectively referred to as the “Service” or “AI Assistant”). By accessing, initiating, or interacting with the Service (including clicking “Start chat” or submitting a message), you agree to be bound by these Terms. If you do not agree, do not use the Service.
Automated Artificial Intelligence Service
We provide access to an automated conversational assistant powered by artificial intelligence, proprietary organizational algorithms, and third-party large language models.
Non-Human Identity: The AI Assistant is an automated software tool and is not a human being or a licensed professional advisor.
Probabilistic Outputs: Outputs are generated via machine learning algorithms and language models. While designed to reflect The ReWild Group’s Organizational ReWilding framework, responses may occasionally be incomplete, inaccurate, or inapplicable to your specific operational environment.
Informational and Educational Purpose Only (No Professional Advice)
THE SERVICE AND ITS OUTPUTS ARE PROVIDED EXCLUSIVELY FOR PRELIMINARY EDUCATIONAL AND INFORMATIONAL PURPOSES.
Non-Consequential Exploratory Use: The Service is designed exclusively for exploratory organizational discovery and is not intended, designed, or authorized to make automated consequential decisions affecting employment status, compensation, credit, legal rights, or contractual obligations.
No Licensed Counseling: The Service does not provide legal, tax, accounting, human resources, certified financial, or formal management consulting advice.
No Fiduciary Relationship: Interacting with the Service does not create a client, advisory, fiduciary, or professional services relationship between you and the Company.
Independent Professional Guidance Required: You agree that you will not make financial commitments, personnel changes, operational reorganizations, or legal decisions based solely on the Service’s outputs without independent evaluation by certified advisors or licensed professionals.
Permitted Business Use & User Conduct
You represent that you are at least 18 years old and are evaluating the Service on behalf of a business enterprise. You agree not to:
Submit Sensitive or Confidential Information: Transmit or submit Social Security numbers, financial account credentials, payment card details, medical or health records, government identification, or proprietary company trade secrets into the chat.
Interfere or Reverse Engineer: Decompile, reverse engineer, extract model weights, tamper with prompt boundaries, bypass security sentinels, or inject adversarial instructions into the system.
Abuse the Platform: Deploy automated scripts, bots, scrapers, or volumetric requests that exceed technical rate limits, message frequency caps, or session thresholds, or otherwise degrade service availability.
Misrepresent Identity: Claim an affiliation or authorization you do not possess.
Intellectual Property Rights
Company IP: All rights, title, and interest in and to the Service, including the ReWild QuickStart assistant persona, trade names, The ReWild Group methodologies, the Organizational ReWilding framework, the compiled diagnostic logic, algorithms, and website code are the exclusive property of the Company or its licensors.
User Inputs: You retain your pre-existing ownership rights in the factual business data you enter into the chat. By submitting information, you grant the Company a non-exclusive, worldwide, royalty-free license to use, process, and display such input solely as necessary to operate the Service, generate outputs, deliver requested summaries, and maintain system security.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE SERVICE, ALL OUTPUTS, AND ALL ASSOCIATED MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, ERROR-FREE, OR VIRUS-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, DEVELOPERS, ADVISORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF DATA, OR WORK STOPPAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) FIVE HUNDRED UNITED STATES DOLLARS ($500.00 USD) OR (B) THE TOTAL FEES ACTUALLY PAID BY YOU TO THE COMPANY FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
THE FOREGOING LIMITATION SHALL NOT APPLY TO: (A) GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; (B) INFRINGEMENT OR MISAPPROPRIATION OF THE OTHER PARTY’S INTELLECTUAL PROPERTY; (C) BREACH OF CONFIDENTIALITY OBLIGATIONS; OR (D) ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
Dispute Resolution, Mandatory Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Informal Resolution First: Before filing any formal claim, you and the Company agree to attempt to resolve any dispute informally. You must submit a written Notice of Dispute detailing the issue and requested relief via our online contact form at https://www.rewildgroup.com/contact. Both parties agree to negotiate in good faith for at least thirty (30) days following receipt of the Notice.
Binding Arbitration: If the dispute is not resolved within thirty (30) days, any controversy, claim, or dispute arising out of or relating to these Terms or the Service shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules, as applicable), available at https://www.adr.org.
Venue and Virtual Hearings: The arbitration shall be conducted in Denver, Colorado, or, at your or the Company’s election, virtually via video conference or telephone.
Fees and Costs: Payment of all filing, administration, and arbitrator fees will be governed by the applicable AAA rules. Each party shall bear its own attorneys’ fees and expenses unless the arbitrator awards otherwise under statutory authority.
Exceptions / Carveouts: Notwithstanding the foregoing, either party may:
Bring an individual action in a small-claims court of competent jurisdiction in Colorado.
Seek preliminary injunctive or equitable relief in court to prevent infringement or misappropriation of intellectual property rights or unauthorized access to the Service.
30-Day Arbitration Opt-Out: You have the right to opt out of this arbitration provision within thirty (30) days of first using the Service. To opt out, you must submit a written notice via our online contact form at https://www.rewildgroup.com/contact stating your full name, email address, and an unambiguous statement that you opt out of arbitration.
CLASS ACTION WAIVER: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative proceeding.
Severability: If any portion of this Section 7 is found unenforceable, that specific portion shall be severed, and the remainder of the arbitration terms shall remain in full force and effect.
Governing Law and Jurisdiction
These Terms and any disputes relating to the Service shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without giving effect to any principles of conflicts of law. To the extent court proceedings are permitted under these Terms, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Denver County, Colorado.
Modifications to Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms.
